The Opportunity: Build at the Dawn of the AI Revolution
Mark Cuban says we’re in the “preseason” of AI, a moment that “dwarfs” the dawn of the internet. He believes the real game-changer won't be a massive corporation, but a nimble innovator who discovers an application so impactful it redefines an entire industry.
At HeartStamp, we are that innovator. We are a well-bootstrapped, generative AI venture poised to fundamentally disrupt a resilient $20 billion+ global industry long controlled by dinosaurs. We are seeking a foundational legal partner to help us build the future.
About Us
HeartStamp is a category-defining hyper-personalization generative AI consumer good brand with both tactile and digital product outputs. Our platform empowers users to create deeply meaningful, emotionally resonant media at scale through an intuitive, proprietary creative engine. Architected for global scale and backed by a robust, modular technology stack, we are primed for Series A and B capitalization with a clear roadmap for worldwide success.
We are building a company at the dynamic intersection of generative AI, a vibrant global creator economy, and tangible consumer products. This is a rare opportunity to join a company at the inflection point of its growth and to shape the legal and ethical framework of a next-generation technology leader.
The Role: A Strategic Architect, Not Just an Attorney
This is not a traditional in-house role; it is a strategic partnership. We are looking for a Founding Counsel to serve as a trusted advisor and a core member of our leadership team. You will be the architect of our legal, compliance, and intellectual property infrastructure, building it from the ground up to support our ambitious global expansion. You will act as the steward of our company's most valuable assets: our technology, our intellectual property, and the trust of our users and creators.
This role demands a unique blend of sophisticated legal expertise, commercial acumen, and a deep comfort with navigating the uncharted legal territory of generative AI.
Key Responsibilities
Your mandate will be broad and impactful, focused on establishing a scalable foundation for growth. Key responsibilities will be strategically grouped into four pillars:
- Generative AI & Product Counsel: Serve as the primary legal advisor on all matters related to generative AI. This includes assessing legal implications of underlying AI models, developing and implementing the company's AI Use and Ethics Policy, and navigating novel legal questions surrounding AI-generated content and authorship.
- Intellectual Property Strategy & Enforcement: Design and execute a comprehensive global IP strategy. You will build and manage our portfolio of trademarks, copyrights, and trade secrets; develop systems for IP protection and enforcement against infringement, piracy, and cybersquatting; and draft the IP-centric agreements that power our creator economy.
- Commercial & Corporate Framework: Draft, negotiate, and manage the full spectrum of commercial agreements that form the backbone of our business. This includes our public-facing Terms of Service, Privacy Policy, and EULA, as well as critical internal agreements for creators, vendors, and strategic partners.
- Global Compliance & Risk Management: Build and oversee a robust, scalable compliance program. You will ensure our platform adheres to global data privacy regulations (e.g., GDPR, CCPA); manage content moderation and DMCA protocols; and proactively identify and mitigate legal risks across all facets of the business.
The Ideal Candidate: Qualifications & Attributes
- We are seeking a seasoned attorney with the experience to provide sophisticated counsel and the entrepreneurial drive to build from scratch.
- J.D. from an accredited law school and active membership in at least one U.S. state bar.
- Extensive experience (7+ years preferred) in intellectual property and technology law, with a significant focus on the legal challenges of digital platforms, software, and emerging technologies.
- Demonstrated, deep expertise in the following areas:
- AI Law & Policy: Verifiable experience advising on the legal and ethical issues of artificial intelligence, including AI-generated content, data usage in model training, and AI safety/ethics policies.
- Intellectual Property Law: Mastery of copyright, trademark, and trade secret law, including portfolio management, licensing, and global enforcement strategies.
- Data Privacy & Cybersecurity: In-depth knowledge of global privacy regimes (GDPR, CCPA/CPRA, etc.) and experience drafting privacy policies and managing data protection programs.
- Commercial Contracts: Proven ability to draft and negotiate a wide range of complex technology and commercial agreements.
- Prior experience as in-house counsel at a high-growth technology startup (ideally as a first legal hire) or as outside counsel serving as the primary advisor to such companies is strongly preferred.
- Exceptional business judgment and the ability to provide practical, risk-calibrated advice that supports, rather than hinders, rapid innovation and growth.
- A proactive, self-starting mindset with a bias for action and the ability to operate with autonomy in a fast-paced, ambiguous environment.
